I heard of a seller who knew that their home had a problem with a certain kind of bug, and did not disclose it. The house fell out of escrow 5 times because people found out on there own. They should have dealt with it before wasting everyones time and money, arn't they liable for not disclosing?
I was representing a buyer about a year ago and we were under contract on a home. During the inspection we both noticed a very foul odor and the listing agent said it was probably from the living room couch which in fact was stained and filthy. However, we smelled it up close and didn't think it was the couch. The inspector went up into the attic where the smell was more potent. He found several dead rats the size of small cats rotting away up there.
I have heard of experiences where new home-owners have found that people had dies in the house prior and that the seller did not disclose it. Now that's gross!
