Exclamation RESPA statute stripped to studs in legal battle over intent, definitions

The claws are coming out as the RESPA class action case in Oklahoma heats up. You know the one: Bohne v. Closings of Tulsa, McGraw Davisson Stewart and their affiliates. After the defendants claimed that the plaintiffs’ had no reasonable cause of action under RESPA, the plaintiffs are now taking apart the RESPA statute to argue congressional intent, define settlement services and peel away the statute of limitations stipulations. And the plaintiffs’ side is also growing, as five new homeowners have now joined the fray...

Doesn’t sound too good.

I am afraid we are about to see stiffer government regulations on commissions unless NAR starts earning their money.

I wonder if any of them have looked at the other side of the real estate business... the one where we spend countless hours chasing our tail with clients that never pan out... for no pay... while spending a lot of money for overhead, MLS, association dues and fees, and marketing, etc. I truly don't understand how the discount brokerages do it and have to wonder if they will fizzle out under the weight of it all eventually.
