5 A B and C in terms of LVH's quote not 4. 4 does not have to happen for 5 to be applicable.

I saw that but doesn't it say for 5(A) to apply that 5(B)(i) must also be satisfied? Again, the $5,000 in damages unless 5(B) (ii), (iii), (iv), or (v) come into the play. I may just be reading this wrong. If so, sorry.

Jay that is only one section of the statue. That quote was for what would apply to this circumtance. Not all sections of that statue will apply to this issue.

That is about the most ignorant metphor I have ever seen.

I am appalled at the comparison of two completely unrelated types of criminal acts. One a violent crime against woman/men, the other a white collar intrusion!

It is unconceivable that someone would make this type of comparison!

Then again the entire event could be perceived as little more than forum spamming although not the case. Perception and metaphors set aside, its difficult to see how anyone can downplay an event based solely on damage assessment.

I’m still not convinced that an employee will readily except jail time and expose him/herself to civil litigation. That would take falling on your sword to a whole new level.

We have not been REW or Morgan bashers but advocates of REALTORS® that you have harmed. Do you honestly expect that when you ban a Member from REW and slam them without a chance to defend themselves that they should remain silent, shrivel up and die?

All threads that were negative towards REW in PREN were legitimate complaints with substantiation.

It wasn’t just a few posts that were deleted. It was entire threads. I know you have real issues with freedom of speech (you demonstrate that repeatedly) but we take it very seriously in the US.

As for contacting council to file a C&D you have threatened me with that before and again I say go for it. As you well know I don’t make claims I can’t backup and I do not intimidate easily. You are accustomed to bullying and intimidation stifling competitors and detractors but it does not work here.

According to others more knowledgeable than myself harvesting passwords from vBulletin is VERY doable.

For you to say that an unnamed overzealous employee is behind all of this and will be reprimanded is totally unacceptable. Your story would be far more credible if you were to name, dismiss and lodge a criminal complaint against him/her with the Canadian authorities.

VegasMack didn’t say that what Morgan did was like raping a woman, he’s trying to show how ridiculous Terry is sounding when he says a thousand different ways that he’s neutral, all the while pointing out a million different scenarios of how in an alternate universe where the law isn’t really the law and the definition of is has more than one meaning, Morgan could be innocent.

Mack was trying to show how silly it would be if someone used the same line of thinking with a rape victim, not compare the two infractions. Morgan posted the same stupid comment in his apology saying that Mack was comparing the two crimes, and now you’re in here regurgitating the same incredibly stupid and immature line of thinking.

Obviously the Kool-Aid that MCHammered is serving up isn’t loaded with sense; either that or you spilled your glass.

Jessie is correct that the analogy to rape was inappropriate. It was a poor choice and should only be used in comparison to other violent crimes.
